Irman’s lawyer: KPU leadership and members violated their oath
Jakarta (MidLand) – The leader of Irman Gusman’s legal team, Arifudin, said that the leaders and members of the General Election Commission of the Republic of Indonesia violated their oaths and promises as organizers of the elections.
“The KPU commissioner prefers to interpret PTUN decision number 600 rather than fulfill his obligation to carry out the orders of the PTUN decision which has permanent and binding legal force,” he said in a written statement in Jakarta on Saturday.
The case of the KPU’s refusal to implement the decision of the State Administrative Court (PTUN) has entered a new stage.
Irman Gusman reported the leadership and members of the Indonesian KPU to the Honorary Council of Election Organizers (DKPP) for alleged serious violations of the code of ethics for organizing elections. The DKPP RI held a hearing on Irman’s report on Thursday (1/2).
This was expressed by Arifudin in response to the KPU’s reluctance to implement the PTUN’s decision, which called for the KPU to reinstate Irman Gusman in the permanent candidate list (DCT) for DPD RI after removing Irman from the previous DCT.

According to Arifudin, the KPU’s actions were actually a violation, even nullifying the oath he had taken while serving as KPU commissioner.
Arifudin hopes that the DKPP will respond to the actions of these defendants (KPU commissioners) as actions that violated the KPU oath and several other ethical principles in accordance with DKPP Regulation number 2 of 2017 relating to the Code of Ethics for Election Organizers.
He added that for violating the oath the penalty is absolute and dishonorable dismissal.
“Because if the behavior of the (KPU) leadership and members who reject the PTUN’s decision-making order is found to be correct, it will pose a threat to the implementation of democracy in the future and set a bad precedent, namely that election organizers prefer legally interpret orders rather than put them into practice. Then we will say what will become of our rule of law later”, he underlined.

In the aftermath of the trial, the Indonesian General Election Supervision Body (Bawaslu), based on the results of its study, also recommended to the DKPP violations of the code of ethics for the organization of elections, which were strongly suspected to have been committed by leadership and members of the Indonesian KPU.
In letter no. 001/Rekom-KE/LP/RI/00.00/1/2024, Bawaslu stated that, based on the plenary meeting of Bawaslu members, there were allegations of violations of the code of ethics for the organization of elections referred to in report no . 001/Reg/RI/00.00/1/2024 with the person reported on behalf of the president and members of the Indonesian KPU (attached), suspected of violating the code of ethics for organizing elections which will then be forwarded to the DKPP.
DKPP member Raka Sandi said his agency is still looking into Irman Gusman’s complaints against KPU leaders and members. Raka is not yet ready to respond on the merits of the ongoing trial.
“We have heard the complaint. And we are currently still continuing the process,” Raka said in Jakarta, Friday (2/2).
